Lip Fillers Gone Wrong – Could You Claim?

You may be wondering if you can claim for bad lip fillers. However, you would only be able to claim if you have sustained injuries following your dermal filler treatment. We will confirm a couple of things before we take your case on:

  • That the practitioner who treated you was negligent in some way; and
  • Because of that negligence, you were injured.

These are just a few examples. Contact our expert solicitors for a free consultation and we will advise you on the next steps if you feel that your treatment was negligent.

Dermal filler claims can be made up to 3 years after the procedure. The time limit begins at either the date of treatment or the date at which the injuries or side effects were diagnosed.

It is more suitable to begin the claim process soon after you get a reason to do so. This is essential to gather the actual evidence to back up your allegations and make your claim stronger.

The compensation for each case is different and depends upon the extent of injury and damage done. Following is some of the estimated financial compensations in dermal filler claims,

  • Minor injuries that recover within a week: a few hundred to max 600 pounds
  • Minor injuries that recover within 3 months: 1000 to 2000 pounds
  • Psychological injuries leading to vulnerability in relationships and ability to cope in life: 5000 to 15000 pounds
  • Severe scarring and facial disfigurement: 20000 to 80000 pounds

See table below for a more comprehensive review of the compensation you may be entitled to.

The Zenith Lawyers team has the expertise and knowledge to help you in making a dermal filler compensation claim. If you or someone you know thinks they have been a victim of negligent cosmetic surgery in the past 3 years, you can directly approach us to start your claim procedure. What are Dermal Fillers?

Dermal fillers are gel-like substances that are injected under the skin to rejuvenate and smoothen it. The most common compound in dermal fillers is hyaluronic acid (HA) which is a natural substance found in the skin, playing a major role in keeping the skin volumized and hydrated.

This cosmetic procedure is done to revive the volume, fullness, and definition of facial and other areas of the body for a youthful appearance. Some dermal fillers can last between six to twelve months while others can last up to five years

Though this process is normally quick and painless, however, things can go wrong if the process is not conducted correctly. According to the British Association of Aesthetic plastic surgeons, about 69% of surgeons report such problems with the dermal filler procedure. Our expert solicitors at Zenith Lawyers have a successful track record in handling cosmetic cases, particularly dermal filler claims. We can guide you throughout the process to evaluate the best outcome. Our team will work closely with you on the case and will perfectly understand the situation and assist accordingly.

What are dermal fillers made of?

There are several different types of dermal fillers and are generally categorized on the basis of their constituents

  • Calcium hydroxylapatite (CaHA)

This is a naturally occurring substance, primarily found in the bones. Calcium particles are used in dermal fillers suspended in a smooth gel having a thicker consistency. These fillers are typically used for deeper lines and wrinkles and last up to a year. They are also known to stimulate natural collagen formation.

  • Hyaluronic acid (HA)

Hyaluronic acid naturally occurs in human skin that helps to keep it hydrated and rejuvenated. Dermal fillers having hyaluronic acid typically last between 6 months to a year and have a gel-like consistency. They are mostly used with lidocaine to ensure a comfortable procedure. FDA approved HA dermal fillers include,

  • Revanesse versa
  • Belotero balance
  • Juvéderm products: Juvéderm XC, VOLUMA, VOLBELLA, VOLLURE
  • The RHA collection: RHA 2, RHA 3, and RHA 4
  • Restylane products: Restylane, Restylane Silk, Restylane Lyft, Restylane Refyne, Restylane Defyne, Restylane Kysse, Restylane Contour
  • Poly-L-Lactic acid

This is a biodegradable and biocompatible synthetic substance that has been used for medical purposes over the years. Poly-L-Lactic acid is also known as a collagen stimulator as products constituting this substance help to smooth out fine lines and rebuild collagen in skin. It is typically used to treat facial wrinkles and the filler can last upto 2 years.

  • Polymethylmethacrylate (PMMA)

PMMA is also a biocompatible and synthetic substance particularly been in use for medical purposes. PMMA fillers also contain collagen and remain beneath the skin for indefinite periods and provide continued support. FDA approved PMMA dermal fillers include Bellafil previously called as artefill

  • Facial fat grafting

Autologous fat injections are administered through surgery typically using liposuction. Body fat from another body part is used and these fillers typically last for several years. Fat injections help to restore volume and fullness of the temples, cheek area, lower eyelids or other facial areas. This particular treatment should be performed by a certified and experienced cosmetic surgeon to ensure a safe procedure.

There are various reasons why someone may opt to have a dermal filler procedure, the most common are:

  • Lip Fillers – plump and fuller lips have become a new fashion statement particularly for women.
  • Cheek Fillers – cheek volume and fullness gets lost as people age. These fillers are administered to restore volume and get a more youthful look
  • Fine lines and wrinkles – to smooth out fine lines and wrinkles and give freshness to the skin
  • Nose Bridge Fillers – to change nose shape and reduce the ridge in the bridge of the nose

The major reason behind opting for dermal fillers is to maintain a youthful appearance and lessen the signs of aging. These procedures are mostly common among women, however, men also undergo the process of dermal fillers.

Dermal fillers are though not dangerous in themselves, however, there are multiple risks associated with their administration. The common side effects of dermal fillers include,

  • Bruising
  • Rash and redness
  • Swelling

Dermal fillers can also cause long-term damage, whose recovery may go beyond surgical help.

Following are the serious risks associated with dermal fillers,

  • Infections due to unsanitary conditions
  • Leaking implants
  • Filler placement problems and lumpiness of the skin
  • Blocked blood vessels lead to continuous pain and skin discoloration
  • Severe and prolonged swelling or bruising
  • Asymmetry or lumps in the lips
  • Scarring

The most severe yet rare side-effect of hyaluronic acid dermal fillers is vascular occlusion which happens when the needle penetrates a blood vessel. This case can lead to serious consequences including blood flow blockage, tissue death, and loss of vision
